Terms of Service

These terms apply when you use BestAvatarGenerator at bestavatargenerator.com. The service is operated by River AI (ABN 56 586 339 011), Australia ("we", "us"). By using it you agree to these terms and to our Privacy Policy.

Who can use it

You must be at least 16 to create an account or upload photos. You are responsible for activity on your account, so keep access to your email and sign-in provider secure.

The service

The avatar builder is free and needs no account. Turning a photo into an avatar uses credits, bought as one-time packs; there is no subscription. AI generation is artistic stylisation: results vary and may not look exactly like you or like the examples.

Your uploads

• Only upload photos you have the right to use. Do not upload photos of other people without their permission, or photos of anyone under 16 unless you are their parent or guardian.
• Do not upload or try to create unlawful, sexual, violent, hateful or harassing content, or use the service to impersonate or deceive someone.
• Uploads are checked automatically and may be rejected. We may remove content or suspend accounts that break these rules.

Credits and payments

• Prices are shown in US dollars and payments are processed by Stripe. Your bank may convert the amount into your currency.
• Each action shows its credit cost before you run it. Failed generations are refunded in credits automatically.
• Credits do not expire, cannot be transferred and have no cash value except as described in our Refund Policy.
• If we increase the credit cost of an existing action we give at least 30 days notice, credits bought before the change keep the old cost, and you may request a refund of unused credits.
• If a payment is disputed or reversed with your bank, the credits from that purchase are removed and the account may be paused until the dispute is resolved.

Your avatars

You own the avatars you create, as far as the law allows, and may use them for any lawful purpose, including commercially, subject to the rights of others (for example, people shown in your photo). You give us permission to store and process your photos and avatars only to provide the service to you. If you submit an avatar to the showcase, you also allow us to display it on the site until you withdraw it.

Our content

The site, the builder and its artwork belong to us. This is an unofficial tool; styles are inspired by public design trends and are not endorsed by any company whose assistant inspired a style (see the Disclaimer).

Availability and changes

We work to keep the service running but do not promise it will always be available or error-free. We may change or discontinue features; if we close the service, we will refund unused paid credits.

Liability

Nothing in these terms excludes rights you have under the Australian Consumer Law or other consumer laws that cannot be excluded. To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability to you is limited to the amount you paid us in the 12 months before the claim.

Ending your account

You can delete your account at any time in Settings. We may suspend or close accounts that break these terms; unless the breach involved fraud or abuse, we will refund unused paid credits.

Governing law

These terms are governed by the laws of New South Wales, Australia. This does not take away the protection of the consumer laws of the country where you live.

Changes to these terms

We may update these terms. We change the date above, and for significant changes we notify you by email or on the site before they apply.
